A. Royce is a mobile app for everyday follow-up (“App”) that we, Friends of Ambition LLP have developed. This App is the perfect assistant for the sales rockstars. It helps them in creating and keeping track of their follow-ups with leads and customers through different modes like call, sms, email, whatsapp, meeting and video meet. The app helps in arresting sales leakages, engage with leads and customers better and improve the productivity of the salesperson. The App allows to capture certain personal information, such as name, contact details, organization, designation etc. (“Personal Information”). 

B. This policy (“Privacy Policy”) is intended to inform you, our customers, how we collect, use, and share Personal Information collected by or through the App or our website role.ai (“Website”)

 

1. Summary

1.1 You will find details of how we use the Personal Information you (our customers) gather using the App or the information collected on the Website, in the section titled “How we use your Personal Information”.

1.2 We generally delete Personal Information you provide when it is no longer needed for the purposes detailed herein; exceptions to this rule and details of our data retention practices are contained in the section titled ‘How long your personal information will be kept’.

1.3 Generally, we do not otherwise share Personal Information provided by you with any third person, but we do use a few external service providers to power our operations with whom we share certain information; For details about our practices and policy in this regard please see the Section titled ‘Who we share your personal information with’.

1.5 This policy is for customers and users of the Royce service. If you are someone who has given their contact details to one of our customers using the Royce service, please see the ‘Use by our Customers’ section below.

1.6 We advise you to read this Privacy Policy carefully as it contains important information in some details on how we collect, store, use and share Personal Information, and rights of Data Subjects (defined herein) in relation to such Personal Information collected via the App and the Website.

2. Applicability of General Data Protection Regulation

2.1 Residents of the European Union (“EU”) should note that this Privacy Policy has been updated in accordance with the requirements of the EU General Data Protection Regulation (the “GDPR”). Depending on the type of information mentioned below, we shall either be Controller or Processors. As per the provisions of the GDPR we shall be considered the Controllers of the Personal Information contained in Prospect Data, Account Data, Log Data and Marketing and Communication Preferences; Whereas we shall be considered Processors in respect of Lead Data, and App Data. The capitalized terms used in this paragraph, have the meaning set forth in the paragraph below.

3. The personal information we collect from you

3.1 We collect the following Personal Information when you provide it to us-

3.1.1 Prospect Data: When you register for a free service, contact us to request more information on the Royce service, download one of our guides or reach out to us, we collect your name, contact details and the company you work for.

3.1.2 Account Data: Details of your usage of the Royce app including the reporting and analysis dashboard.

3.1.3 Lead Data: Details of contacts imported from your address book after your permission, details of leads you interact which is captured on the App, such as the name and contact details of the lead, organization, designation, messages, discussion notes etc. Such data is uploaded to our cloud servers. However, voice recordings are stored in the mobile handset and not uploaded on our servers.

3.1.4 App Data: Details of your usage of the Royce mobile App, including details of the company you work for, your username, and data relating to your activity in the App, such as details of the leads you have interacted/followed up with, what kind of conversations you had with your prospect etc.

3.1.5 Log Data: Technical data from the device on which you install the Royce App, being the device type and operating system version.

3.1.6 Marketing and Communication Preferences: Your preferences as to whether we contact you with promotional information about Royce. We use this to make sure we don’t send you anything you have asked not to receive.

3.1.7 Communications: We will record the fact that you have contacted us (or we have contacted you) and may retain the content of the communication, together with your contact details and our responses.

4. How we use your information

This section tells you what uses we make of your information.

4.1 We use Personal Information in the following ways:

4.1.1 To allow us to operate the App, and the business operations we engage in, including facilitating your use of the Royce dashboard and the App, and supporting any operational or technical queries you may raise. 

4.1.2 To use data analytics to improve our Website, products/services, marketing, and user relationships and experiences. 

4.1.3 To administer and protect our business. 

4.1.4 To deliver relevant Website, blog and webinar content and promotional emails we send to you and measure or understand the effectiveness of them. 

4.1.5 We use your Marketing and Communication Preferences to make sure we don’t send you anything you have asked not to receive. 

4.1.6 We will also use your information in the event that we need to enforce our terms of service, or to help us defend any legal claims against us. 

4.1.7 We may also need to process your data for compliance with a legal obligation to which we are subject.

4.1.8 If you give us your consent, we may publish your feedback about Royce on our Website or marketing material.

5. The legal basis on which we process your information

5.1 The GDPR requires all organisations that process personal data to have a ‘Lawful Basis’ for doing so. The lawful bases on which we process Personal Information listed above are as follows:

5.1.1 Legitimate Interest: means the legitimate interest of us, in our conducting and managing our business to enable us to give you the best service and the best and most secure Royce experience. We make sure we consider and balance any potential impact on persons whose Personal Information is collected (“Data Subjects’) (both positive and negative) and their rights before we process such Personal Information for our legitimate interests. We do not use Personal Information for activities where our interests are overridden by the impact on Data Subjects (unless we have the consent of such Data Subject or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on Data Subjects in respect of specific activities by contacting us at privacy@friendsofambition.com.

5.1.2 Performance of Contract: means processing Personal Information where it is necessary for the performance of a contract between you and us or to take steps at your request before entering into such a contract.

5.1.3 Legal Obligation: means processing Personal Information where it is necessary for compliance with a legal or regulatory obligation that we are subject to.

5.1.4 Consent: Data Subject’s affirmative consent to particular instances of our processing Personal Information.

6. Who we share your personal information with

6.1 The Website may contain features or links to web sites or mobile app and services provided by third parties. Any information you provide on third-party sites or services is provided directly to the operators of such services and is subject to those operators’ policies, if any, governing privacy and security, even if accessed through the App. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links or access are provided through the App. We encourage you to learn about third parties’ privacy and security policies before providing them with information.

6.2 We use the following service providers to help us process Personal Information:

6.2.1 Our hosting partner, Amazon Web Services for storing the data in the cloud;

6.2.2 Google Workspace. 

6.2.3 Google Analytics & UX cam;

6.2.4 TechStalwarts Software Development LLP-Development and Application        maintenance partners;

6.2.5 Additionally, we may disclose your data to third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use the Personal Information in our possession / control;

6.2.6 We may share Personal Information with other companies in the Royce group of companies, to provide the Royce service and for internal administration purposes, as well as with a small pool of trusted professional advisors in order to obtain advice, our advisors are all bound by professional codes of conduct as well as obligations of confidentiality;

6.2.7 We may also share Personal Information where we consider it is required as follows:
– to comply with applicable laws, regulations or any judicial order
– to enforce our contractual rights under our terms of service or otherwise
– to protect the security, rights, privacy, safety and property of Royce, of you, or of others.

6.2.8 We will not share any Personal Information with third-parties for their direct marketing purposes to the extent prohibited by California law. If our practices change, we will do so in accordance with applicable laws and will notify you in advance.

6.2.9 lease note that in case of Business use, your organization would appoint an administrator (in relation to the App and the Royce Services used by your organization as a whole). This administrator, would be provided access to the Lead Data and App Data collected by you through/ using the App.

7. App Permission

7.1 We take permission before adding contacts in the app from your address book. This data will not be shared by us with anyone.

7.2 We take one time permission to use your camera for photonotes, profile picture, and for your leads profile pictures.

7.3 We take one time permission to use your microphone for taking voice notes.

7.4 We take one time permission to access your storage for sending attachments, accessing images for photonotes, lead profile pictures and your profile picture. 

7.5 SMS: We take one time permission to send automated SMS on your behalf via SMS scheduled function. We use this access to send SMS configured by you.   

7.6 Gmail: We use  your Google Gmail account (if granted access) to send emails on your behalf via the email scheduled function. We use this access to send emails configured by you (creating an email scheduled). We do not access, store or share any Google user data or account information. 

8. How long your Personal Information will be kept

8.1 We retain Prospect Data for as long as we are in contact with the prospective customer and for 13 months thereafter.  Our service is new to a lot of companies, and we will retain some of the data in our CRM, so that we can pick up conversations quickly from the past, unless you tell us you don’t want us to contact you anymore.

8.2 We retain some of the Account Data (such as customer employee names, contact details, job title) for the duration of our provision of the services to the customer and in our internal systems thereafter, to allow for providing the service to returning customers. Where a departing customer requests that this data is deleted sooner, we would of course accommodate such requests. 

8.3 We retain App Data and Lead Data or the duration of our provision of the services to the customer.

8.4 We retain Log Data for as long as we provide services to you and 90 days after.

8.5 We may retain information on your Marketing and Communication Preferences for a reasonable period after you expressed interest in our services in order to send you updates, let you know about the new features you might be interested in, etc. Occasionally, we may contact you to make sure that you are still interested in being subscribed to these communications. We will hold your information until you tell us you no longer wish to receive any communications from us.

8.6 We may retain financial / transactional information about our dealings with your organization for as long as required by the law applicable to us.

9. Cross Border Transfer of your information 

9.1 We may transfer your Personal Information to third party service providers, which are located outside India and the EEA. We do this to help us provide and promote the Royce service and to help us engage with our customers and prospective customers.

9.2 Such countries may or may not have same data protection laws of the European Union. Any transfer of your Personal Information will be subject to appropriate safeguards as permitted under the General Data Protection Regulation or India Law, that are designed to help safeguard your privacy rights and give you remedies in the unlikely event of a misuse of your Personal Information.

10. Use by our customers

10.1 Our customers use the Royce service to follow-up with their leads through different modes like call, sms, WhatsApp, email, video meet and meeting and to capture their interaction through customized modules and notes. We take standard one time permission from our customers before setting up the follow-up modes for call, sms and email. We do not control the content of the modules or notes, or the information or content that our customers use Royce for follow-up. That information or content belongs to our customers, and in the language of data protection laws, they are the ‘data controller’ of it. They process it in accordance with their own privacy policy (which should be available for viewing before the information is captured) and is not subject to this Privacy Policy. We process the information or content on our customers’ behalf as ‘data processor’, and do not retain any personal data collected by our customers, or use their information or content for our own purposes. We have no direct relationship with any person from whom our customers use Royce to obtain personal data. We are not responsible for our customers’ use of information they collect on the Royce service. If you have any questions or comments about the use by an Royce customer – or you wish to exercise your rights as a data subject in respect of processing of your data by an Royce customer – please contact the customer. We will be pleased to assist them in any valid request from you in respect of your exercising your rights as a data subject, but as a ‘data processor’ we will refer to the customer any such requests that come direct to us.

11. Your rights

11.1 Under the General Data Protection Regulation Data Subjects have a number of important rights. In summary, those include rights to:

11.1.1 access to your Personal Information and to certain other supplementary information that this Privacy Policy is already designed to address

11.1.2 require us to correct any mistakes in your Personal Information which we hold

11.1.3 require the erasure of Personal Information concerning you in certain situations

11.1.4 receive the Personal Information concerning you which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to a third party in certain situations

11.1.5 object at any time to processing of Personal Information concerning you for direct marketing

11.1.6 object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you

11.1.7 object in certain other situations to our continued processing of your Personal Information

11.1.8 otherwise restrict our processing of your Personal Information in certain circumstances

11.1.9 be notified in case of data breach concerning your Personal Information, if it affects your rights and liberty 

The aforementioned rights are available to Data Subjects against controllers. Where we act as a Controller, reaching out to us would be enough for us to help you, however, where we are the Processors, we would need to obtain instructions from the Controller before we can act on your request.

11.3 If you would like to unsubscribe from any promotional material we send you, you can also click on the ‘unsubscribe’ button at the bottom of the email.

12. Keeping your data secure

12.1 We follow generally accepted industry standards to protect the information submitted to us, both during transmission and once we receive it. We maintain appropriate administrative, technical and physical safeguards to protect data against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the data in our possession. This includes, for example, Amazon Web Services security compliance, encrypted password protection, and other access and authentication controls. 

12.2 However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. We cannot ensure or warrant the security of any information you transmit to us or store on the Service, and you do so at your own risk. We also cannot guarantee that such data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If you believe your Personal data has been compromised, please contact us as set forth in the “How to Contact Us” section.

12.3 If we learn of a security systems breach, we will inform you and the authorities of the occurrence of the breach in accordance with applicable law. 

13. Data of children

13.1 Our app and services are not intended to target any persons under 16, and we do not knowingly collect data of children under 16.

13.2 If you think we have collected or are processing information about a person under 16, please contact us at privacy@friendsofambition.com so we can investigate and delete this data.

14. Changes to this Privacy Policy

14.1 This Privacy Policy was last updated on 18th November 2022.

14.2 We may make changes to this Privacy Policy at any time, please ensure you check it periodically. Any material changes to this Privacy Policy will be notified to you via email, or an update in the app, or in an App notification.

14.3 Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which we may update from time to time. Your continued use of the App and our service in relation thereto, after the revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Policy.

15. Limitation of Liability

15.1 To the extent permissible under the law, we shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, information, or other tangible or intangible losses (even if we have been advised of the possibility of such damages), arising out of this Privacy Policy or the Terms and Conditions, on your use of the App, the Website or our services.

16. Governing Laws and Disputes

16.1 This Privacy Policy shall be construed and governed by the laws of India without regard to principles of conflict of laws. Any dispute arising, between you and us shall be submitted to exclusive jurisdiction of the courts in Mumbai. 

16.2 For any EU residents, this Privacy Policy shall be governed by the provisions of the GDPR.

17. Disclosure

17.1 Royce does not use and transfer any information received from Google API to another app. We adhere to Google API Services User Data Policy, including the limited use requirements.
